According to the stipulated in the D.L. 24/2014, of February 14th, the present general terms and conditions aim to regulate and are fully applicable to the celebration and formalization of any contract of sale/order of products and articles from PANDORA, that is performed by any consumer (hereinafter referred to as "client") through the site www.PANDORAonline.pt (hereinafter referred to as "site") in Portuguese territory.
The sale and supply of products and Pandora articles through the identified site is, under any circumstances, made by the company called Visão do Tempo II Distribution, S.A. (hereinafter referred to as VT II, SA), based on Praceta das Fábricas nº 2-2A, Outurela, 2790-064 Carnaxide, with VAT NUMBER: 508649277. Visão do Tempo II, S.A. is the owner of PANDORA stores in Portugal, brand owned by PANDORA a/s, headquartered in Hovedvejen 2, 2600 Glostrup, Denmark.
Clients may contact us to request information, ask questions or make suggestions or complaints through the following means:

You acknowledge that the conclusion of an order through the site, determines the full and unconditional acceptance of these terms and conditions, which should be read and expressly confirmed by the client upon completion of any order. The content of these terms and conditions are at all times available for printing and storage for clients.
VT II, SA reserves the right to proceed at any time and without prior notice, to any changes to these terms and conditions, amendments which, however, shall apply only to contracts of sale/orders to be formalized after the disclosure on the site of the indicated changes.
Contracts will only be made with clients major of age, with full legal capacity.
INFO ON PANDORA PRODUCTS AND ARTICLES
All PANDORA products presented and marketed through the site are listed in detail in the respective sections of each of the categories, news or collections, and the respective characteristics can be visualized through graphical representations on the field "details" of each of the items or products available.
VT II, SA will develop all efforts to ensure that the products presented and marketed on the site are available for immediate purchase by the client and that are only accessible for viewing the products and references with existing stock. If stock ruptures occur to any product or articles submitted with the consequent impossibility of immediate acquisition by the client, such information will be communicated at the time of completion/order confirmation, as described in the nº 5 "order confirmation" of these terms and conditions of sale.
The indicated price of the products is the unit value by which VT II, SA sells articles and products through the site, which includes all applicable taxes. The price corresponding to deliveries, which will be added to the price of the goods or articles purchased, should be supported by the client and is presented at the moment immediately preceding the act of completion of the order.
To purchase a product through the site, the client should register in advance through the provision and integration of data requested and, after confirmation of the registration, accessing the site through the introduction of the respective data.
After insertion of the displayed data, the client can choose any items or products that wishes to purchase, and, to this end, click on "add to cart" and indicate the number of units wanted.
After you add to the "cart" all products that you wish to purchase, the customer must enter "my purchases" where it will be introduced to all the articles and products selected and added by the client.
You may, if you wish, delete one or more products added to the "cart" and, to this end, click the corresponding command.
To complete the order in progress, the client must enter the data requested on each of the steps presented concerning the order, billing, shipping and payment.
The insertion of incorrect or incomplete data information, prevents the processing and completion of the order, and VT II S.A. will not be responsible for any losses from such acts.
After the correct insertion of the requested data, the client must check carefully the "Summary" of the respective order, which shall comprise:
- All of the articles to be acquired and added to the "shopping cart";
- The value to be paid by the client for the selected articles
- The value of the delivery of items to purchase
- The total value of the order that will result from the sum of the items purchased and value applicable to delivery of the products.
After such verification and acceptance, the client must complete and validate the respective order by clicking, for this purpose, in "Finalize Order", recognizing the client, that such validation represents the formalization of the contract of purchase and sale of the articles in question.
At the time VT II, SA receives the proof of payment of the total value of the order, it will send the client a confirmation e-mail. All orders made can be viewed and consulted on "client area", in "My orders"
After the completion of the payment of the total value of the order, and without prejudice to the right of resolution provided in paragraph 8 of the present general terms and conditions, the order can only be cancelled in the case of processing still pending.
The client may make the payment of the orders through a Visa card or through PayPal, being the total amount debited to the relevant associated account.
The payment of the order takes place in real time, through the Virtual POS system and as soon as you verify that the personal data provided is correct.
VT II, SA guarantees total security and confidentiality of the data corresponding to the payment method used, and the details of the card used for payment transmitted through encrypted SSL.
In order to detect and prevent any frauds in transactions and payments operated through the site, VT II, SA adopts sophisticated preventive mechanisms, such as, among others, on the analysis of characteristics of orders and their comparison with fraudulent transactions previously recorded.
In certain situations and to ensure that the transaction in progress does not constitute a fraudulent operation, VT II, SA may request additional information or the provision of additional data.
If the client refuses to provide or make available such additional information, this will not allow VT II, SA to verify the authenticity of the operation, and therefore VT II, SA reserves the right to not continue and/or accept the order.
The client acknowledges that, in spite of the advanced technological systems and mechanisms adopted by VT II SA in order to prevent and detect fraudulent operations, it does not guarantee full reliability of the system and may result in transactions that, notwithstanding their legitimacy, are classified by VT II SA as fraudulent.
In the case referred to in the previous paragraph, the client who has been unable to proceed with certain legitimate operation, should contact VT II SA at the number indicated in these terms and conditions, and VT II SA commits to accept and complete, with the highest speed, the desired order.
The client acknowledges that, to all intents and purposes, entities that provide the services associated with the orders, as well as providing the different types of payment, may adopt other anti-fraud measures that are not controlled by VT II, SA, which may determine the rejection of certain operations. VT II, SA does not control and is not responsible for any damages that may result from the application of security policies and fraud that are used by these suppliers or entities.
The client acknowledges and accepts that, in the case of payment of products made through PayPal, the total value of the order will be immediately debited on the PayPal account.
If the payment of the total value of the order is effected by credit card, the conclusion of the order will onlly occur when the respective credit is verified.
If the Bank rejects the transaction, the order will be automatically cancelled.
If the amount charged on the client’s card number is the result of a fraudulent operation or misuse by any third party, the client may request the immediate cancellation of the charged value by sending an e-mail, in which case VT II, SA, will refund the respective amount.
If the allegedly fraudulent operation was actually triggered by the client and this requires the cancellation of the same, it shall compensate VT II, SA of any damage resulting from the respective cancellation.
On the invoice to be issued shall be considered the information provided by the client and listed the prices of the products purchased, the value of the postage and the applicable VAT, not being, in any case, possible the modification of the information contained in the same.
CONFIRMATION OF ORDER/REQUEST
In accordance with the above paragraph 3, the completion and validation of order occurs at the moment when the client clicks "Confirm Purchase", recognizing this, for all purposes, without prejudice of the confirmation email that will be sent by VT II SA within 24 hours, such validation is the formalization of the contract of purchase and sale of the articles in question.
The confirmation email will indicate the order number the client should use in any communication that he may want to keep with VT II, SA., undermining the client to verify that the data/products listed in his order are correct and indicate any changes or inaccuracies in a timely manner. The eventual inaccuracies that are not reported in a timely manner, will be exclusively supported by the client.
The clients can view on their "Personal Area" all orders made or contact the customer service of VT II, SA to that same purpose.
In case, one or more of the products ordered are not available, VT II, SA notifies the client about their unavailability, being that:
- If the order form submitted only contains one reference, and the same is not in stock, VT II, SA performs the cancellation of the order;
- If the order form contains two or more articles and some of them are not available, VT II, SA confirms the order and shall send the items available.
DISPATCH AND DELIVERY
The order is sent through the express transport company Chronopost and the delivery will be made in one of the following methods to be selected by the client:
- Home delivery - at the time of dispatch of the order the customer receives an SMS notification indicating the date of delivery. On the day of delivery it receives a new notification by SMS to indicate the commitment timeline of the same. The client has however the possibility to change the date and/or location of delivery by contacting directly Chronopost. To avoid that the delivery is not successful to the address stated, the client shall indicate, during the purchase process, an alternative delivery point that is most convenient for him.
- Delivery in the Shops network - for his convenience, the client can choose to receive the order in one of the shops of the network of Chronopost, near his home or workplace. At the time of shipment it will receive an email notification indicating the date of delivery. On the day the order arrives to the store selected by the client, this, receives an SMS indicating the order number and the address of the store, to proceed to the picking. The client shall provide the order number and an identification document.
The package will only be available on the selected store during a period of 10 business days from the date of notification of the arrival to the store.
All shipments are only made for Mainland Portugal and the Archipelagos of Madeira and Azores.
The transport and delivery of the order will be made through Chronopost and the respective proof of reception as to be signed by the client or by a person who is properly authorized to receive the article or product ordered, assuming, for all intents and purposes, that any person found in the place of delivery indicated by the client is empowered to receive the order.
VT II, SA only sends the orders for Mainland Portugal and the Archipelagos of Madeira and Azores, and will not accept a post office box as domicile.
Shipping charges are a responsibility of the client and vary between Mainland and the Islands and depending on the delivery type selected (Values provided during the ordering process)
For orders in which the amounts are equal or bigger than € 99 shipping costs will be assumed by VT II, SA.
The order will be delivered between 2-3 business days on the mainland and between 3-5 business days for the islands , since the payment is made to the 14h of the day on which the order has been submitted .
VT II SA implements, in certain circumstances, different types of promotions or sales with discounts through the site.
These promotions and discounts shall be subject to the conditions expressly stated for each individual promotion, as well as to these terms and conditions of sale, and the client recognizes that in case of conflict, shall prevail the rules applicable to the specific conditions of the promotion.
If the promotion announced has, as its objective the offer of a good or product, and the client exercises his/her right of resolution or return of the item purchased, this offer shall also be returned.
The offers received cannot be sold or transferred to third parties by the client in order to obtain, directly or indirectly, economic profit.
The client may resign the free offer, however cannot apply for or obtain any compensation for waiver the same.
During the periods of promotional campaigns active on PANDORA ONLINE, orders will only be considered to include promotional items after payment. It is mandatory that the payment need to be made before the end of promotion
The client acquiring any PANDORA product through the site may exercise their right to free resolutions pursuant to article 11 of DL 24/February 14, 2014.
The right of resolution provided, for in paragraph 1, shall be exercised within 14 days from the date of reception of the order by the client, by communication of its intention to the e-mail email@example.com or by completing and submitting the form of free resolution appended to these terms.
In case of resolution, the customer must keep the articles and products purchased in order to return them to VT II, SA, within 30 days of the date of its reception.
The returns made by the client under the right of resolution should be sent by post (CTT) to the address Praceta das Fábricas nº 2-2A, Outurela, 2790-064 Carnaxide.
The article should always be returned with the respective invoice, just being accepted returns of items in the same condition in which they were sent and without any sign of use.
Exercised the right of resolution, under paragraphs 1, 2 and 3 above, VT II, SA shall refund the client the price paid without any costs or charges for this, being repayment carried out through the same form of payment. In the existance of any previous shipping costs, these will not be included.
In the case of an exchange the client should send the articles by post (CTT) to the address Praceta das Fábricas nº 2-2A, Outurela, 2790-064 Carnaxide. The article should always be accompanied by the invoice. Exchanges are accepted only from articles in the same condition in which they were sent.
AFTER SALES SERVICES
All items sold by VT II, SA are covered by 2 years manufacturer warranty, ensured by the brand. After the extinction of the warranty, VISÃO DO TEMPO, S.A. also provides technical assistance. In the case of faulty products or malfunction, they should be reported to the e-mail firstname.lastname@example.org as soon as possible. Whenever the repair entails costs for the client the same will only be initiated after the acceptance of the budget presented to the client.
WARRANTY OF THE PRODUCTS
Pursuant to Decree-Law No. 67/2003, 8 April, with amendments introduced by Decree-Law No. 84/2008, of May 21, all PANDORA products are covered by a warranty of conformity of the goods corresponding to a period of 2 (two) years.
During the warranty period the product to present manufacturing defects will be repaired free of charge or will be replaced by a similar model.
In cases where it is not possible to repair the product, the client will have to present the nonconforming product, along with the original and respective certificate of warranty properly and completely filled out (indicating the date of purchase, dealer's name and address and the reference assigned to the product – when applicable - or the product designation) and the invoice of sale or other suitable proof of purchase. Are exclusions of warranty the materials subject to breakage (ex: murano beads, stones and pendants), loss, deterioration, rust, defects caused through coups, improper use, inadequate maintenance, negligence, improper handling, unauthorized modifications, repairs, accidents or normal wear and tear and damage caused by the use of other products not PANDORA associated with or in conjunction with these.
All prices include VAT at the statutory rate.
Sale prices are recommended but subject to any editing errors.
Visão do Tempo II reserves the right to change prices and/or the characteristics of products and services without previous notice.

PROCESSING OF PERSONAL DATA
Complying with the law No. 67/98 of 26 October 1999 concerning the Protection of personal data, we inform you that the processing of personal data collected on the site www.PANDORAonline.pt is a responsibility of VT II, S.A.
The data collected on the site is intended for processing orders and communicating with clients, processing requests for information and possible complaints, statistical analysis, as well as their use for the purposes of direct marketing.
VT II, SA guarantees the confidentiality of all data provided by its clients, warning that, although VT II, SA collects and processes data securely and engaged with all the technical measures to prevent their loss or manipulation, the respective collection is performed in a open network, which is likely to allow the movement of personal data made available and as well as its use and viewing by unauthorized third parties, and VT II S.A. cannot be liable for any damage caused.
VT II SA gives the client, at any time, the right of access, rectification or deletion of their personal data, as well as the right to object to the processing of the same, the written request should be sent to the e-mail address or to the address indicated above.
INTELLECTUAL AND INDUSTRIAL PROPERTY
All texts, comments, works, illustrations, movies and images reproduced or represented on the site www.PANDORAonline.pt are, worlwide, properly protected by their copyright. Therefore and in accordance with the Code of Copyright and other Related Rights, will only be allowed the use for private purposes, without prejudice to more restrictive provisions contained in the mentioned code. Any reproduction, total or partial representation of the www.PANDORAonline.pt site or, of all or part of the elements included in the same, is strictly prohibited under penalty of recourse to competent legal means, against who acts that way.
Social names, trademarks, and any distinguishing marks reproduced on the site www.PANDORAonline.pt are protected in accordance with the legal provisions applicable to industrial property. Reproduction or representation of all or part of these distinctive signs is strictly prohibited and should be subject to a prior written consent of the respective owners.
APPLICABLE LEGISLATION AND JURISDICTION
The law applicable to any contractual relationship that has been established through the site of VT II, SA is the Portuguese law.
To resolve any conflict arising from any contract concluded in accordance with these general conditions of sale will be the competence of the Judicial Court of Oeiras district, expressly renouncing any other.
